  • Acceptance of Terms: Welcome to the official website for the festival presented by GourmetGala Entertainment Consultants LLC (the “Festival”). By accessing, browsing, or using this website, you acknowledge that you have read, understood, and agree to be bound by these legally binding terms and conditions and to comply with all applicable laws and regulations.
  • Disclaimer of Warranties: This website and all its content are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. The Festival expressly disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing or usage of trade.
  • Limitation of Liability (Website): Under no circumstances shall the Festival or its affiliates be liable for any direct, indirect, incidental, special, punitive, or consequential damages that may result from the use of, or the inability to use, this website, including but not limited to reliance by a user on any information obtained from the website or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction, or unauthorized access to our records, programs, or services.

II. Event Ticket Holder Agreement & Policies

This agreement is made between the Festival and the ticket holder (“You”). It should be displayed during the ticket purchasing process and referenced on all tickets.

  • Assumption of Inherent Risks: You acknowledge that attendance at a large public event like the Festival involves significant inherent risks, including but not limited to, risks of personal injury, illness (including exposure to communicable diseases like COVID-19, influenza, and norovirus), permanent disability, death, and property damage. These risks may arise from the actions, inactions, or negligence of others; the conditions of the premises (including uneven terrain, temporary structures, and crowds); or the consumption of food and alcohol. By using this ticket, you expressly and voluntarily assume all such risks.
  • Waiver of Liability and Indemnification: In consideration for being permitted to attend the Festival, you hereby, for yourself, your heirs, executors, and administrators, release, waive, discharge, and covenant not to sue GourmetGala Entertainment Consultants LLC, its parent and affiliated companies, officers, directors, members, employees, volunteers, contractors, sponsors, and participating vendors (the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, direct or indirect, arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or to any property belonging to you, whether caused by the negligence of the Released Parties or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted. You further agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorneys’ fees, they may incur due to your attendance at the Festival.
  • Event Conduct & Ejection: You agree to conduct yourself in an orderly and respectful manner. We reserve the right, without refund of any portion of the ticket price, to refuse admission to or eject any person whose conduct management deems disorderly, abusive, or who fails to comply with event rules. This includes, but is not limited to, behavior that is racist, sexist, homophobic, transphobic, or otherwise discriminatory, as well as any form of harassment.
  • Search and Prohibited Items: You and your belongings may be searched upon entry. The following items are strictly prohibited: Outside food and beverages, coolers, illegal substances, drugs or drug paraphernalia, weapons of any kind (including pocket knives, pepper spray), flammable items, drones, professional photo/video/audio equipment without a media pass, laser pointers, and any other item deemed dangerous or inappropriate by event staff. The Festival reserves the right to confiscate any prohibited items.
  • No Refunds & Force Majeure: All sales are final. Tickets are non-refundable. The event is rain or shine. In the event of a cancellation or postponement due to circumstances beyond our control (including but not limited to, acts of God, terrorism, war, government regulations, disaster, strikes, civil disorder, public health emergencies, or any other emergency making it illegal or impossible to hold the event), refunds will not be issued.
  • Ticket Resale: Unauthorized resale or attempted resale of this ticket is grounds for seizure and cancellation without compensation. Tickets are revocable licenses and may be revoked at any time for any reason without compensation. Tickets may not be used for advertising, promotions, contests, or sweepstakes, without the express written consent of the Festival.

III. Alcohol & Responsible Consumption Policy

  • 21+ Event: The Festival is a strictly 21-and-over event. No one under the age of 21, including infants in strollers or designated drivers, will be admitted.
  • Valid ID Required: A valid, unexpired, government-issued photo ID (e.g., driver’s license, state ID card, passport, military ID) is required for entry. Photocopies or digital images of IDs will not be accepted. The use of a false or borrowed ID is illegal and will result in confiscation of the ID, denial of entry, and potential prosecution.
  • Responsible Consumption: We encourage responsible consumption. Tastings are intended for sampling. Intoxicated guests will not be served and may be removed from the festival grounds without a refund. DO NOT DRINK AND DRIVE.
  • Right to Refuse Service: All festival staff and vendors are trained in responsible alcohol service and reserve the absolute right to refuse service to any guest who appears intoxicated or is behaving irresponsibly.
  • Florida Dram Shop Law Notice: Florida Statute 768.125 provides that a person who sells or furnishes alcoholic beverages to a person of lawful drinking age shall not thereby become liable for injury or damage caused by or resulting from the intoxication of such person, except that a person who willfully and unlawfully sells or furnishes alcoholic beverages to a person who is not of lawful drinking age or who knowingly serves a person habitually addicted to the use of any or all alcoholic beverages may become liable for injury or damage caused by or resulting from the intoxication of such minor or person.
  • Transportation: Plan ahead. Arrange for a designated driver, or use a taxi, public transit, or ride-sharing service.

IV. Health, Safety, & Medical

  • Food Allergies & Dietary Needs: The Festival features a variety of food vendors. We cannot guarantee that any food item is free of specific allergens (e.g., nuts, soy, gluten, dairy). It is your sole responsibility to inquire with each vendor about ingredients before consumption. The Festival and its vendors assume no liability for adverse reactions to food consumed. You consume all food and beverage at your own risk.
  • Communicable Disease Acknowledgment: You acknowledge the inherent risk of exposure to communicable diseases like COVID-19, influenza, and norovirus in any public setting. By attending, you voluntarily assume all risks related to such exposure and agree not to hold the Released Parties liable for any illness or injury.
  • Medical Consent: You consent to receive medical treatment from event staff or other medical personnel that may be deemed advisable in the event of injury, accident, or illness during the event. This consent does not create a duty on the part of the Festival to provide such care. You release the Festival and all medical personnel from any and all liability for any such actions. You are responsible for any and all medical costs incurred.
  • Security: The Festival employs security personnel, but their presence does not guarantee your safety. You are responsible for your own personal security and that of your belongings.

V. Photography & Videography Release

By entering the festival grounds, you irrevocably grant GourmetGala Entertainment Consultants LLC and its authorized partners the perpetual, worldwide, royalty-free right to use your image, likeness, name, voice, and actions in any live or recorded audio, video, or photographic display or other transmission, publication, or reproduction made of, or at, the event in any and all media, whether now known or hereafter developed, for any purpose, without compensation or further notice.

VI. Governing Law, Jurisdiction, & Dispute Resolution

  • Governing Law: These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
  • Jurisdiction: Any legal action or proceeding arising under these terms will be brought exclusively in the federal or state courts located in St. Johns County, Florida, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
  • Dispute Resolution: Any controversy or claim arising out of or relating to these terms shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

VIII. Miscellaneous Provisions

  • Entire Agreement: These terms and conditions, together with the Privacy Policy, constitute the entire agreement between you and the Festival regarding your attendance and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
  • Severability: If any provision of these terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.
  • No Waiver: The failure of the Festival to enforce any right or provision of these terms will not be deemed a waiver of such right or provision.
